Despite Hiei's view of the whole matter, Kurama insisted on being nearby in case he was needed. Sleeping with the fire apparition had been to help while he was suffering through chills, the fox knowing that body heat would help, not to detain him in any way. If Hiei had actually told him to leave he would have, although that wouldn't have stopped him from checking in periodically and assisting with his care.

If he was improving Kurama wasn't going to push him back into a recovery bed or demand some form of supervision. Hiei is an adult, he can make his own choices. Frankly, the spirit fox is just relieved to see him doing better.
